Terms of Service

These Terms of Service (the "Terms") govern access to and use of Sistema 10K (the "Service"), the web platform available at www.sistema10k.com.ar. Please read them carefully: by creating an account, logging in or using the Service you accept these Terms and the Privacy Policy. If you do not agree, do not use the Service.

1. Who provides the Service

Sistema 10K is operated by Joaquín Vega, an individual based in Rosario, Province of Santa Fe, Argentina ("we", "us"). Contact: vegajoaquins@icloud.com.

2. What Sistema 10K is

Sistema 10K is an analytics and content-organization tool for social media creators and businesses. Among other features, it lets you:

Connect Instagram profiles and TikTok accounts through their official APIs and view their statistics on a dashboard.
Automatically record the daily evolution of followers and posts.
Analyze video performance by profile and by topic.
Plan posts and track a daily posting goal.
Generate ideas, scripts, stories and analyses with artificial intelligence tools.

Sistema 10K is not an official product of TikTok, Meta, Instagram, Google or Anthropic, and is not sponsored or endorsed by them.

3. Eligibility

You must be at least 18 years old and legally able to enter into contracts.
You must own, or be authorized by the owner of, every social media account you connect.
For Instagram, you must use a professional (creator or business) account, as required by the Instagram API.
You must comply with these Terms, applicable laws and the terms of every platform you connect.

4. Your account

Using the Service requires an account. Accounts are currently created by invitation from the administrator. You are responsible for keeping your username and password confidential and for all activity under your account. You must provide accurate information, keep it up to date and notify us immediately at vegajoaquins@icloud.com if you suspect unauthorized use. You may not share, sell or transfer your account.

5. Connecting TikTok, Instagram and other services

The TikTok connection uses TikTok Login Kit: you expressly authorize each permission on TikTok's screen. The Instagram connection uses an official Instagram API token that you generate.
Sistema 10K only reads the authorized information (profile, statistics and public videos). It does not post, edit, delete, comment or send messages on your accounts.
By connecting an account you also accept that platform's terms and policies, including the TikTok Terms of Service and the Instagram Terms of Use.
You can disconnect or delete any connected account at any time from the Connections section or from the platform itself. See Data deletion.
Integrations depend on third-party services that may change, limit or interrupt their APIs. We are not responsible for such interruptions, although we will make reasonable efforts to keep the integrations working.

6. Plans, prices and payments

Plans: the final price in Argentine pesos, the billing period (monthly) and what each plan includes (number of connected profiles and AI requests per month) are shown on the home page and in "My subscription" before you subscribe.
Free trial: when you sign up you may get a free trial with no card required, subject to the limits shown. When it ends you need to choose a plan to keep using the Service.
Billing: subscriptions are paid through Mercado Pago (credit card, debit card or account balance). Mercado Pago processes the payment; we never see or store your card details.
Renewal: the subscription renews automatically every month for the same amount unless you cancel it.
Cancellation: you can cancel at any time from "My subscription" with one click, through the same channel you used to subscribe. You will not be charged again and you keep access until the end of the period already paid. Partial periods are not refunded, except as provided for withdrawal.
Plan changes: if you switch plans, the new amount is charged from the next period and the new limits apply immediately.
Withdrawal: if you are a consumer, you may revoke the purchase within 10 calendar days without cost or liability, under Article 34 of Argentine Consumer Protection Law No. 24,240, using the withdrawal button or by contacting us. We refund the amount paid through the same payment method.
Non-payment: if Mercado Pago cannot charge the renewal, access to the features is suspended when the paid period ends (plus a few grace days) and restored as soon as the payment goes through. Your data is kept until you delete your account.
Prices: we may change plan prices; you will be notified at least 30 days in advance and may cancel before the change applies.
Accounts granted by the administrator: accounts created by invitation are governed by the conditions communicated when they were created.

7. Acceptable use

You may not use the Service to:

Connect third-party accounts without their authorization or access data that does not belong to you.
Violate laws, third-party rights or the terms of TikTok, Instagram or other platforms.
Attempt unauthorized access to systems, accounts or other users' data, or circumvent security measures.
Reverse engineer, scrape or extract data in bulk or by automated means, or overload or interfere with the Service.
Use the AI tools to generate content that is illegal, misleading, defamatory, discriminatory, infringing or that promotes hatred or violence.
Resell, sublicense or commercially exploit the Service without our written consent.

8. Your content

Content you upload or generate on the platform (notes, sequences, scripts, chats) and the data of your connected accounts remain yours. You grant us only a limited, non-exclusive, royalty-free license to store, process and display it to you for the sole purpose of providing the Service, for as long as you use the platform. You are responsible for holding the necessary rights to the content you upload.

9. Artificial intelligence features

Ideas, scripts, texts and analyses generated with AI are automated suggestions: they may contain errors or inaccuracies, or be similar to outputs for other users. Review them before use. They are not professional advice (legal, financial, real estate or otherwise) and do not guarantee growth results. To generate them we send your request and the necessary context to our AI provider, as explained in the Privacy Policy.

10. Intellectual property

The software, design, the "Sistema 10K" brand, logos and texts of the Service belong to us or are used under license and are protected by intellectual property laws. We grant you a personal, limited, non-exclusive and non-transferable right to use the Service under these Terms. TikTok, Instagram and other third-party marks belong to their respective owners.

11. Privacy

The processing of your personal data is governed by our Privacy Policy, which forms part of these Terms.

12. Availability and changes to the Service

We work to keep the Service available and working properly, but there may be interruptions due to maintenance, technical failures or causes beyond our control. We may add, change or discontinue features; if we discontinue the Service, we will give reasonable advance notice so you can request a copy of your data.

13. Suspension and termination

You may stop using the Service and request closure of your account at any time by contacting us. We may suspend or close an account that breaches these Terms, when required by law or when its use puts the Service or other users at risk; except in serious or urgent cases, we will notify you first. After closure we will delete your data as described in the Privacy Policy.

14. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted or error-free, that third-party metrics will be accurate at all times, or that its use will produce any particular follower growth or business results.

15. Limitation of liability

To the fullest extent permitted by applicable law, we are not liable for indirect damages, lost profits, loss of data or opportunities arising from the use or inability to use the Service, or for acts of third-party platforms. Our total liability to you is limited to the amount you paid for the Service in the 12 months preceding the event giving rise to it. Nothing here limits non-waivable rights under Argentine Consumer Protection Law No. 24,240 or liability that cannot be excluded by law.

16. Indemnity

You agree to hold us harmless from third-party claims arising from your breach of these Terms, the content you upload or connecting accounts you are not authorized to connect.

17. Governing law and jurisdiction

These Terms are governed by the laws of the Argentine Republic. Any dispute will be submitted to the competent ordinary courts of the city of Rosario, Province of Santa Fe, unless you are a consumer, in which case you may go to the courts of your domicile under Law No. 24,240.

18. Changes to these Terms

We may modify these Terms. We will publish the new version on this page with its date and, for material changes, notify you by email or in the platform at least 10 days in advance. Continuing to use the Service after that date means you accept the changes; if you disagree, you may close your account.
